Terms of service

Effective Date: 8th August 2025


1. Introduction

These Terms and Conditions (Terms) are a legally binding agreement between you (you or the user) and Buzza Pty Ltd (Buzza, we, us, or our), an Australian company with its principal place of business in Sydney, NSW, Australia, governing your access to and use of:


  • Our website (www.buzza.com.au)


  • Any related applications, dashboards, or digital platforms


  • Our AI receptionist and related products and services (together, the Service).


By using our Service, you confirm you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Service.


We may update these Terms at any time. When we do, well update the Effective Date and, where required by law, provide notice before changes take effect.


2. Key Definitions

For the purposes of these Terms:

  • User any person or entity accessing or using our Service.


  • Account your registered profile required to use certain features.


  • Content any information, media, or data stored or transmitted via the Service.


  • Subscription a paid plan granting ongoing access to the Service, billed on a recurring basis.


  • Inbound Calls calls answered by our AI receptionist on your behalf.


  • Outbound Calls calls initiated by our AI receptionist on your behalf.


  • Compliance Requirements all relevant laws, regulations, and industry standards (including but not limited to the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and the Do Not Call Register Act 2006 (Cth)).


  • AI Platform Buzzas proprietary AI-powered communication platform.


  • AI-Generated Content any text, audio, or other material generated by our AI based on user input.


3. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use our Service. By using the Service, you confirm you have authority to enter into this agreement.


4. Description of Services

Buzza provides AI-powered receptionist services, including:


  • 24/7 automated call answering


  • Human-like AI interactions with callers


  • Outbound calling (e.g., reminders, follow-ups, or marketing where lawful)


  • Appointment scheduling and call forwarding


  • SMS messaging during calls


  • Multilingual support


  • Customisable AI behaviour and responses


  • Analytics dashboards with call logs and performance reports


5. Account Registration

To use certain features, you must create an Account with accurate details and keep them up to date. You are responsible for all activity under your Account and must keep your login secure.


6. User Responsibility

You are solely responsible for:


  • The content and purpose of all calls made through the Service


  • Ensuring your use complies with all applicable Australian laws and regulations


  • Obtaining any necessary consent from call recipients


  • Honouring the Do Not Call Register and anti-spam obligations


  • The timing and frequency of outbound calls

We provide the platform but do not give legal advice. You should seek your own legal counsel on compliance matters.


7. Prohibited Use

You must not use the Service to:

  • Break any Australian laws


  • Harass, abuse, or defame anyone


  • Infringe intellectual property rights


  • Distribute spam or malicious code


  • Make unlawful or unsolicited calls or send messages without consent


  • Interfere with the security or operation of the Service


  • Call emergency services or other restricted lines unless authorised


We reserve the right to suspend or terminate your Account for misuse.


8. Compliance Requirements

You must comply with all relevant laws, including:

  • Australian Consumer Law (Competition and Consumer Act 2010)


  • Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs)


  • Spam Act 2003 (Cth)


  • Do Not Call Register Act 2006 (Cth)


We may request evidence of compliance and may suspend your access if we reasonably believe you have breached these requirements.


9. Subscription & Fees

Access to the Service is on a subscription basis.

  • Fees are set out on our pricing page and are subject to change with prior notice.


  • Subscriptions are billed in advance monthly or annually and renew automatically until cancelled.


  • Usage-based fees (e.g., per-minute call charges) are billed in arrears and added to your monthly invoice.


  • All prices are in Australian dollars (AUD) and include/exclude GST as stated.


9.1 Subscription Periods

The Service is offered under three distinct subscription terms: (a) month-to-month; (b) fixed term of six (6) months; or (c) fixed term of twelve (12) months (each a Subscription Term). By selecting and commencing a Subscription Term, you agree to pay the applicable fees for the entirety of that Subscription Term, regardless of actual usage.

9.2 Commitment to Term

Upon acceptance of a Subscription Term, you are contractually bound for the full duration of that term. Cancellation prior to the expiry of the Subscription Term will not entitle you to any refund, credit, pro-rata adjustment, or early termination, except as required under the Australian Consumer Law. Your access to the Service will remain active until the conclusion of the Subscription Term.

9.3 Automatic Renewal

At the end of a Subscription Term, your subscription will automatically renew for a further term equal in length to the expiring Subscription Term (i.e. a month-to-month term will renew for one month; a six-month term will renew for six months; a twelve-month term will renew for twelve months) at the then-current rates, unless cancelled prior to renewal.

9.4 Billing and Payment

All Subscription Term fees are payable in advance, unless otherwise expressly agreed in writing by Buzza AI. Usage-based fees (including, without limitation, per-minute call charges) will be billed in arrears and added to your invoice for the applicable billing cycle. All fees are stated in Australian dollars (AUD) and are exclusive or inclusive of GST as specified.

9.5 Price Changes

Buzza AI may amend its pricing at any time for any renewal Subscription Term, provided that notice is given to you no less than fourteen (14) days prior to the renewal date.


10. Free Trials & Cancellations

We may offer free trials. At the end of a trial, your subscription will automatically start unless cancelled beforehand. You can cancel anytime through your Account or by contacting us.


11. Refunds

We generally do not offer refunds except as required under the Australian Consumer Law or otherwise stated in these Terms.

11.1 General Rule

Except as expressly required under the Australian Consumer Law, all fees paid to Buzza AI are strictly non-refundable, non-creditable, and not subject to pro-rata adjustment, irrespective of whether the Service is used, partially used, or unused during any portion of the Subscription Term.

11.2 Mid-Term Cancellations

If you terminate your subscription prior to the expiry of the applicable Subscription Term, you remain liable for payment of all fees due for the remainder of that Subscription Term. Early termination shall not entitle you to any refund, credit, or offset, except where mandated by the Australian Consumer Law.

11.3 Usage-Based Charges

All usage-based charges (including, without limitation, per-minute call charges) are billed in arrears and are payable in full without set-off or deduction, even if the subscription is cancelled or terminated prior to the applicable invoice date.

11.4 Refund Method

Where a refund is required under the Australian Consumer Law, Buzza AI will process the refund using the original payment method, unless otherwise agreed in writing.


12. Intellectual Property

We retain all rights to the Service, software, and related intellectual property. You retain ownership of your data but grant us a licence to use it for providing and improving the Service.


13. AI-Generated Content

You are responsible for reviewing and verifying any AI-generated material before using it. We make no guarantees as to its accuracy, completeness, or suitability.


14. Privacy

Our Privacy Policy explains how we collect, use, and disclose your information. By using our Service, you agree to the Privacy Policy.


15. Service Availability & Changes

We may modify, suspend, or discontinue parts of the Service at any time. We are not liable for any loss caused by downtime or changes to the Service, except as required by law.


16. Limitation of Liability

To the extent permitted by law:

  • We exclude all warranties not expressly stated in these Terms.


  • We are not liable for any indirect or consequential loss.


  • Our total liability for all claims is limited to the amount you paid us in the 3 months before the claim arose.


Nothing in these Terms limits your rights under the Australian Consumer Law.17. Indemnity. You indemnify us against all losses, costs, and liabilities arising from your misuse of the Service or breach of these Terms.


18. Termination

We may suspend or terminate your Account immediately if you breach these Terms. You may terminate your subscription at any time; no refunds will be given unless required by law.

18.1 Termination by You

You may terminate your subscription by providing written notice to Buzza AI in accordance with clause 9.3. Termination shall take effect at the end of the current Subscription Term, subject to the required notice period. No refunds, credits, or pro-rata adjustments will be issued for any unused portion of a Subscription Term, except as required under the Australian Consumer Law.

18.2 Termination by Us

Buzza AI may suspend or terminate your account immediately if you breach these Terms, engage in unlawful conduct, or fail to pay any fees when due. Such termination will not relieve you of your obligation to pay all amounts owing for the remainder of the current Subscription Term.


19. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
